Dispute Resolution

IT ALSO CONTAINS A JURYTRIAL WAIVER AND A WAIVER OF ANY AND ALL RIGHTS TO PROCEED IN A CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL OR REPRESENTATIVE ACTION, TOTHE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. FINALLY, IT REQUIRES YOUTO BRING CLAIMS WITHIN ONE YEAR OF WHEN THE EVENTS CREATING THE CLAIM TAKE PLACE.

Any and all disputes, claims, or controversies arising out of or relating to the Terms of Use(including the Privacy Policy), or any transaction or communication conducted or made by or through the Site (“Claims”), shall be governed by and construed in accordance with the internal laws of the State of Florida without giving effect to any choice or conflict of law provision or rule (whether of the State of Florida or any other jurisdiction). For clarification, the definition of Claims set forth above includes non-contractual disputes, claims, or controversies. All Claims shall be instituted exclusively in the federal courts of the United States or the courts of the State of Florida, in each case located in the City of Tampa and County of Hillsborough. Both you and Applied Photonix waive any and all objections to the exercise of jurisdiction by such courts and to venue in such courts.

YOU AND APPLIED PHOTONIX irrevocably and unconditionally waive, to the fullest extent permitted by applicable law, any right THAT EITHER party MAY have to a trial by jury in any legal action related to a Claim.

YOU AND APPLIED PHOTONIX EACH AGREE THAT ANY PROCEEDING WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL,OR REPRESENTATIVE ACTION. YOU AND APPLIED PHOTONIX EACH FURTHER AGREE TO WAIVE ANY RIGHT TO BRING OR TO PARTICIPATE IN SUCH AN ACTION TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. ANY AND ALL CLAIMSYOU MAY BRING MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE EVENTS GIVING RISE TO THE CLAIM TAKE PLACE; OTHERWISE, THE CLAIM IS PERMANENTLY BARRED.

This Section (Dispute Resolution) will survive termination of these Terms of Use.

International Users

‍The Site is operated from the United States. If you access the Site from outside the United States, you do so at your own initiative and are responsible for compliance with local laws.

Governing Law

‍The Terms of Use are governed and interpreted pursuant to the laws of the State of Florida, UnitedStates of America, notwithstanding any principles of conflicts of law.

Severability

‍If any part of the Terms of Use is unlawful, void or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of remaining provisions.
